  63. YOUR PRODUCT WITH MCAFEE SOFTWARE, INC. ("MCAFEE"), WILL 
  64. IMPROVE COMMUNICATIONS WITH MCAFEE. A Registration forms 
  65. are is located below. [If you purchased the product directly
  66. from McAfee, you are already registered.]
  67.  
  68. 1. LICENSE GRANT. McAfee and its suppliers grant to you a 
  69. non-exclusive, non-transferable right to use the SOFTWARE 
  70. on file servers connected to a maximum number of user 
  71. computers, or on a maximum number of user computers, not 
  72. exceeding the number of user computers specified on the 
  73. packaging for this product. If the media upon which the 
  74. SOFTWARE is received by you contains versions of the 
  75. SOFTWARE for different operating systems (e.g. VirusScan 
  76. for OS/2 and VirusScan for Windows 95), then you may only 
  77. use the version of the SOFTWARE applicable to the 
  78. operating system used on the user computer for which the 
  79. SOFTWARE is licensed; provided, however, that any license 
  80. to use VirusScan for Windows 3.1x also includes a license 
  81. to use VirusScan for DOS. You agree you will only copy the 
  82. SOFTWARE into any machine-readable or printed form as 
  83. necessary to use it in accordance with this license or 
  84. for backup purposes in support of your use of the SOFTWARE. 
  85. This license is effective until terminated. You may 
  86. terminate it at any point by destroying the SOFTWARE 
  87. together with all copies of the SOFTWARE. Also, McAfee 
  88. has the option to terminate if you fail to comply with 
  89. any term or condition of this Agreement. You agree upon 
  90. such  termination to destroy the SOFTWARE together with 
  91. all copies of the SOFTWARE.
  92.  
  93. 2. UPGRADES. This license is limited to the version of
  94. the SOFTWARE enclosed and does not include the right to
  95. upgrades except as provided in this Section 2.  If you
  96. purchased this software from a retail store or directly
  97. from McAfee, you are entitled: (a) as to products other
  98. than VirusScan Deluxe, to download and use all upgrades
  99. of the SOFTWARE (including virus signature files (DAT
  100. files)) released during the one year period following
  101. purchase; and (b) as to VirusScan Deluxe, to download and
  102. use all upgrades of the SOFTWARE (including virus signature
  103. files (DAT files)) released during the two year period
  104. following purchase. If you received the SOFTWARE packaged
  105. with PC hardware or software not purchased from McAfee,
  106. you are entitled to one free electronic update of the
  107. SOFTWARE. If the PC hardware with which the SOFTWARE was
  108. received was purchased for individual or home use, then
  109. you are further entitled to download and use all upgrades
  110. of the SOFTWARE (including virus signature files (DAT
  111. files)) released during the three month period following
  112. purchase. If the PC hardware with which the SOFTWARE was
  113. received was purchased for business use, then you may
  114. download and use all upgrades of the SOFTWARE (including
  115. virus signature files (DAT files)) released during the
  116. three month period following purchase upon obtaining a
  117. corporate password from McAfee. You must in any event
  118. register with McAfee to receive upgrades hereunder.
  119.  
  120. 3.  COPYRIGHT. The SOFTWARE is protected by United States 
  121. copyright law and international treaty provisions. You 
  122. acknowledge that no title to the intellectual property in 
  123. the SOFTWARE is transferred to you. You further 
  124. acknowledge that title and full ownership rights to the 
  125. SOFTWARE will remain the exclusive property of McAfee or 
  126. its suppliers, and you will not acquire any rights to the 
  127. SOFTWARE except as expressly set forth in this license. 
  128. You agree that any copies of the SOFTWARE will contain 
  129. the same proprietary notices which appear on and in the 
  130. SOFTWARE.
  131.  
  132. 4. REVERSE ENGINEERING. You agree that you will not 
  133. attempt to reverse compile, modify, translate, or 
  134. disassemble the SOFTWARE in whole or in part.
  135.  
  136. 5. LIMITED WARRANTY. For 30 days from the date of 
  137. shipment, we warrant that the media (for example 
  138. diskettes) on which the SOFTWARE is contained will be 
  139. free from defects in materials and workmanship.
  140.  
  141. 6. CUSTOMER REMEDIES. If the SOFTWARE does not conform to 
  142. the limited warranty in Section 5 above ("Limited 
  143. Warranty"), your sole remedy shall be to return the media 
  144. with a description of the problem to McAfee. The defective 
  145. media in which the SOFTWARE is contained will be replaced 
  146. by McAfee at no additional charge to you. If you do not 
  147. receive media which is free from defects and materials 
  148. and workmanship during the 60-day warranty period, McAfee 
  149. will refund to you the amount you paid for the SOFTWARE. 
  150. The Limited Warranty is void if failure of the SOFTWARE 
  151. has resulted from accident or from abuse or misapplication 
  152. by you. Any replacement SOFTWARE will be warranted for 
  153. the remainder of the original Limited Warranty period.
  154.  
  155. 7. NO OTHER WARRANTIES. NEITHER McAFEE NOR ITS SUPPLIERS 
  156. WARRANT THAT THE SOFTWARE IS ERROR FREE. EXCEPT FOR THE 
  157. EXPRESS LIMITED WARRANTY IN SECTION 5 ("LIMITED WARRANTY"), 
  158. McAFEE AND ITS SUPPLIERS DISCLAIM ALL OTHER WARRANTIES 
  159. WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS OR IMPLIED, 
  160. INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF 
  161. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND 
  162. NONINFRINGEMENT OF THIRD PARTY RIGHTS.

  164. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED 
  165. WARRANTIES OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY 
  166. MAY LAST, OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR 
  167. CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR 
  168. EXCLUSIONS MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES YOU 
  169. SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS 
  170. WHICH VARY FROM JURISDICTION TO JURISDICTION.

  172. 8. SEVERABILITY. In the event of invalidity of any 
  173. provision of this license, the parties agree that such 
  174. invalidity shall not affect the validity of the remaining 
  175. portions of this license.

  177. 9. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT 
  178. SHALL McAFEE OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY 
  179. CONSEQUENTIAL, SPECIAL, INCIDENTAL OR INDIRECT DAMAGES 
  180. OF ANY KIND ARISING OUT OF THE DELIVERY, PERFORMANCE OR 
  181. USE OF THE SOFTWARE, EVEN IF McAFEE HAS BEEN ADVISED OF 
  182. THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL McAFEE'S 
  183. OR ITS SUPPLIERS' LIABILITY FOR ANY CLAIMS, WHETHER IN 
  184. CONTRACT, TORT OR ANY OTHER THEORY OF LIABILITY, EXCEED, 
  185. IN THE AGGREGATE THE LICENSE FEE  PAID BY YOU, IF ANY.

  187. 10. GOVERNING LAW. This license will be governed by the 
  188. internal laws of the State of California. The United 
  189. Nations Convention on Contracts  for the International 
  190. Sale of Goods is specifically disclaimed.
  191.  
  192. 11. ENTIRE AGREEMENT. This is the entire agreement between 
  193. you and McAfee and its suppliers which supersedes any 
  194. prior agreement or understanding, whether written or oral, 
  195. relating to the subject matter of this license.
  196.  
  197. 12. NetRemote users are licensed to use the SOFTWARE on 
  198. one LAN connected user computer.  Additionally, users are 
  199. licensed to use the SOFTWARE on a maximum number of 2 
  200. user computers connected by an asynchronous/modem 
  201. connection.
  202.  
  203. U.S. GOVERNMENT RESTRICTED RIGHTS
  204. Any distribution or license of the SOFTWARE to the U. S. 
  205. Government or its agencies or instrumentalities (the 
  206. "Government") is made only with RESTRICTED RIGHTS.  Use, 
  207. duplication or disclosure by the Government is subject to 
  208. restriction as set forth in subparagraph (c) (1) (ii) of 
  209. the Rights in Technical Data and Computer Software clause 
  210. at DFAR 252.227-7013, or as set forth in the particular 
  211. department or agency regulations or rules which provide 
  212. McAfee protection equivalent to or greater than the 
  213. above-cited clause.  Contractor/Manufacturer is McAfee

  588. Before you install a McAfee product that you've downloaded 
  589. from an online service, you'll want to verify that the files 
  590. you downloaded are exactly the same as when we posted them 
  591. online. We recommend you perform this task for maximum 
  592. anti-virus protection. Read the following paragraphs to 
  593. learn how to validate your file.

  595. Included in the files you downloaded is the Validate program
  596. (version 2.0.1). Validate is a file-authentication program 
  597. that you can use to check program files for signs of 
  598. tampering. Validate uses two methods of generating Cyclic 
  599. Redundancy Checks (CRCs), then displays the information so you 
  600. can compare these statistics against the "known value" for the 
  601. program files. The dual CRC checking provides a high degree 
  602. of security. The known value you use for validation is usually
  603. provided by the author of the program, or you may receive it
  604. from a trusted information database. You can find the statistics
  605. for this McAfee product in the file PACKING.LST.

  607. To confirm that a program file has not been tampered with,
  608. run the Validate program and record the validation data
  609. produced. Compare this data against the file statistics
  610. the program author has specified. If the information matches,
  611. most likely the program has not been modified since the files
  612. were placed online.
